| 1.1 The customer may not contravene any legal restrictions, contra bonos mores and rights of third parties (trademark law, right to bear a name, copyright, data protection law, etc.) through chat content implemented by customer or any third party, especially any statements made there (such as defamatory, slanderous, or politically extremist statements). Furthermore, the customer may neither offer pornographic content nor offer or allow any profit-oriented services to be offered which have pornographic and/or erotic content (e.g. nude pictures, peep shows, etc.) 1.2 1&1 shall not be obliged to verify the customer's chat content regarding the aforesaid infringements of law. After any infringement of law or any content which is impermissible pursuant to section 1.1 has been detected, 1&1 shall be entitled to disable the 1&1 WebChat and/or the Internet site of the customer. The customer is committed to using exclusively the Chat application software provided by 1&1. No commercial or for profit distribution and utilization of the 1&1 WebChat is permitted. 1&1 explicitly instructs the customer that data protection for data transmission in open network, such as the Internet, but especially using chat systems, cannot be comprehensively ensured based on the current state-of-the-art. Other Internet participants may under some circumstances be able to intervene in the network security and gain unauthorized control over the message traffic/flow.
